Nintendo sues Trump administration over ‘illegal’ tariffs that delayed Switch 2 pre-orders

Remember when pre-orders for the Nintendo Switch 2 were delayed last year due to President Trump’s tariffs? Nintendo sure is.

Now that the Supreme Court has done it he was knocked down Trump taxes, Nintendo wants money back, with interest. That’s not an expression, either; The lawsuit asks the court to order the immediate return of the “illegal” tax money with interest and attorney’s fees.
Nintendo’s lawsuit is a direct response to the Supreme Court’s decision last month, which struck down Trump’s signature tax, implemented under the International Emergency Economic Powers Act of 1977 (IEEPA). Nintendo is one of the more than 1,000 companiesincluding FedEx and Costco, who are now suing over the tariffs.
Gamers will recall that Trump’s pricing came as Nintendo readied the launch of its new Switch 2 video game console last year. Because of uncertainty around prices at the time, Nintendo delayed pre-orders for the Switch 2.

Meanwhile, Nintendo, Microsoft, and other companies that were forced to raise prices or delay shipments often surprisingly blamed “changing market conditions” rather than naming Trump and the tariffs. But now that the Supreme Court has ruled against President Trump, companies are being embarrassed.
“[Nintendo] has been seriously harmed by the illegal issuance and imposition of unauthorized Executive Orders and the corresponding payment of IEEPA Duties,” the lawsuit states. Nintendo is asking the court to order “immediate reimbursement, with interest, of any IEEPA Duties owed [Nintendo] regardless of the nature of the sale, and grant any remedies the Court deems fit.”
Technically, Nintendo is not only suing the Trump administration but also the United States of America itself, which is clearly named as a defendant in the lawsuit, Nintendo of America Inc. v. United States of America. The lawsuit also names a number of Trump administration officials (including recently fired Homeland Security Secretary Kristi Noem) as well as US Customs & Border Protection, the US Treasury Department, and the US Commerce Department.
Nintendo finally launched the Switch 2 on its originally scheduled release date, and with its $449.99 price tag unchanged. However, many Switch 2 accessories have had their prices increased due to cost.
Trump’s tariffs have hit the tech industry hard, with companies hiking prices of products such as laptops and gaming accessories. As Mashable reported at the time, giant companies like Nintendo faced tax costs exceeding $1 billion per quarter. Now, many want a refund.
Shortly after last month’s Supreme Court decision, Trump announced a new global tax rate of 10 percent and threatened to raise it to 15 percent.
In terms of tax refunds, the court will ultimately decide whether they will receive a refund. However, one thing seems certain. Consumers who had the costs of Trump’s taxes passed on to them through price increases will not see any of that money back.
